Terms and Conditions for Monthly $50 Visa Gift Card Giveaway (“Terms”)

NO PURCHASE IS NECESSARY TO ENTER THIS PROGRAM OR RECEIVE A REWARD. PLEASE READ THESE TERMS CAREFULLY. THIS PROGRAM IS VOID WHERE PROHIBITED BY LAW.

1. Eligibility
This Visa gift card giveaway program (the “Program”) is being conducted by Wireless Maritime Services, LLC, d/b/a Cellular at Sea (“Cellular at Sea”), and is open to legal residents of the United States who are 18 years of age or older as of the start of the month during which the Program is conducted and who agree to and fully comply with these Terms. Because these Terms form a legally binding agreement with respect to the Program, please read them carefully. If you do not agree to the Terms, you are not eligible to participate in the Program. Employees and agents of Cellular at Sea or its affiliates and their immediate family members are not eligible to participate in the Program.

2. Reward
One eligible person will be selected each month during the Program to receive one $50 Visa gift card, which may be redeemed at any merchant or retailer that accepts Visa gift cards (the “Reward”). Completing the survey does not guarantee receiving the Reward. The Reward is non-transferable and cannot be exchanged for cash or any other form of compensation.

3. Giveaway Period
The Program will run monthly through December 31, 2025 from the 1st day to the last day of each calendar month during such period.

4. How to Enter
To participate, entrants must complete and submit the web-based post cruise survey that can be found at the URL provided to you by Cellular at Sea. Only one entry per person per month is allowed. Multiple entries from the same person will be disqualified.

5. Limited Availability
Rewards are available while supplies last.

6. Winner Selection and Notification
The winner will be chosen at random by Cellular at Sea from all eligible entries. The winner will be notified by Cellular at Sea via SMS after the end of the month. If the winner does not respond within 7 days of being notified, the prize will be forfeited, and a new winner will be selected.

7. Conduct
By applying for the Program, you agree to comply with and be bound by these Terms and any additional Program information provided to you during the Program. Failure to comply with these Terms may result in your disqualification from the Program. You further agree to comply with and be bound by the decisions of Cellular at Sea regarding your eligibility to participate, which are final and binding in all respects. Cellular at Sea reserves the right in its sole discretion to disqualify any participant its finds to be violating the Terms or attempting to tamper with the Program. Any false information provided within the context of the Program is a violation of these Terms and may result in the immediate disqualification of a participant and forfeiture of any Reward.

8. Information.
You represent and warrant that the information you provide while applying for and during the course of the Program is accurate and agrees to notify Cellular at Sea if changes occur. You agree that information you provide while applying for Program or that is related to the Program may be shared with third parties for purposes of determining eligibility for the Program, ensuring compliance with Program objectives, analyzing data, and using such data in accordance with Cellular at Sea’s then-current privacy policy located HERE.

9. Publicity
By entering this giveaway, participants grant Cellular at Sea the right to use their name, likeness, and entry materials for promotional purposes without further compensation, attribution, or rights of approval, unless prohibited by law.

10. General Terms

• This giveaway is in no way sponsored, endorsed, or administered by Visa, or any other third-party platform.
• Winners of the prize should note this gift card is considered taxable income.
• Cellular at Sea reserves the right to cancel or modify the Program at any time without notice to any participant.

11. Disclaimer
CELLULAR AT SEA MAKES NO CLAIMS OR GUARANTEES OF ANY KIND WITH RESPECT TO A PARTICIPANT’S ELIGIBILITY TO PARTICIPATE IN THE PROGRAM. CELLULAR AT SEA IS NOT RESPONSIBLE OR LIABLE FOR ANY INCORRECT OR INACCURATE PROGRAM ENTRY INFORMATION, AND ASSUMES NO RESPONSIBILITY FOR (I) TYPOGRAPHICAL OR OTHER ERRORS IN THE PRINTING OF THE PROGRAM MATERIALS OR THE OFFERING OR ANNOUNCEMENT OF ANY REWARD, (II) FAILURE OF ANY ENTRY TO BE RECEIVED BY CELLULAR AT SEA DUE TO TECHNICAL PROBLEMS, TELEPHONE OR NETWORK SERVICE PROBLEMS, HUMAN ERROR, OR TRAFFIC CONGESTION ON THE INTERNET OR AT ANY WEBSITE, (III) COMMUNICATIONS LINE, HARDWARE AND/OR SOFTWARE FAILURES, (IV) THEFT OR DESTRUCTION OF, TAMPERING WITH, UNAUTHORIZED ACCESS TO, OR ALTERATION OF ENTRIES AND/OR PROGRAM ENTRY INFORMATION, OR (V) ENTRIES WHICH ARE LATE, LOST, STOLEN, DAMAGED, ILLEGIBLE, AND/OR UNINTELLIGIBLE (OR ANY
COMBINATION THEREOF).

12. Liability
PARTICIPANTS ASSUME ALL RISK OF PARTICIPATION IN THE PROGRAM. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO INDEMNIFY AND AGREE TO KEEP CELLULAR AT SEA, ITS AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “CELLULAR AT SEA PARTIES”) INDEMNIFIED AT ALL TIMES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES THAT ARISE FROM OR ARE RELATED TO ANY ACT, DEFAULT OR OMISSION BY YOU AND/OR A BREACH OF ANY WARRANTY BY YOU AND/OR TO ANY ACT, DEFAULT OR OMISSION BY YOU UNDER THESE TERMS, INCLUDING WITHOUT LIMITATION RESULTING FROM OR IN RELATION TO ANY BREACH, NON-OBSERVANCE, ACT, OR OMISSION WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THESE TERMS BY YOU. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO HOLD THE CELLULAR AT SEA PARTIES HARMLESS FROM ANY INJURY OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATION IN THE PROGRAM AND/OR USE OR ACCEPTANCE OF ANY REWARD OTHER THAN FOR: (1) DEATH OR PERSONAL INJURY ARISING AS A RESULT OF CELLULAR AT SEA’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; OR (2) CELLULAR AT SEA’S FRAUDULENT MISREPRESENTATION. CELLULAR AT SEA HAS NO LIABILITY TO ANY PARTICIPANT FOR ANY LOSS, DAMAGE, COSTS OR EXPENSE INCURRED AS A RESULT OF OR IN CONNECTION WITH A PARTICIPANT’S PARTICIPATION IN THE PROGRAM.

13. Data Privacy
WMS takes commercially reasonable measures to secure and protect personal information on the Services. Nevertheless, no security system is impenetrable. We cannot guarantee that personal information that users of the Services transmit or otherwise supply will be secure. Any personal information or data collected during the course of the Program by Cellular at Sea will be used only for administering the Program pursuant to these Terms, and as otherwise described in Cellular at Sea’s then-current privacy policy located HERE.

14. Governing Law
This giveaway is governed by the laws of the State of Florida, U.S.A., with regard to its principles of conflicts of laws.

15. General
Cellular at Sea’s failure to enforce any term of these Terms shall not constitute a waiver of that provision. If any provision(s) of these Terms are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
